OFFIS e.V. places great value on complying with data protection regulations. We would therefore like to explain to you below how we gather your personal data.

When you apply for one of our job vacancies, we will process those items of your personal data required for the selection process and to verify your suitability for the relevant advertised vacancy and/or that you provide to us in order to verify your suitability for the advertised vacancy. This could be contact data as well as all data relating to the application (résumé, certificates, qualifications, answers to questions, etc.). We will carry out the selection procedure in-house using our own staff members. When doing so, as a matter of principle the only individuals within the company who will be given access to your data are those who require it to ensure that the application procedure is conducted in an orderly manner. The legal basis for this Art. 6 Para. 1 (b); Art. 88 General Data Protection Regulation (GDPR) in conjunction with Sect. 26 Para. 1 German Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG).
In addition to this, within the scope of the application procedure we will ask you whether we may use your application for vacancies other than the one that you are applying for. If you do not agree to this, it will not impact the application process. If you provide your consent, then where applicable we will consider your application details for other in-house vacancies that match your qualifications and forward your details to the relevant department or person. The legal basis for this is your voluntarily provided consent as per Art. 6 Para. 1 (a) GDPR. You can withdraw your consent at any time without this affecting the lawfulness of any processing that has already been carried out. The withdrawal of consent will not affect data processing as per Sect. 26 Para. 1 BDSG that relates to the vacancy that you are specifically applying for.
We also continue to explicitly welcome speculative job applications. The personal data that you provide to us in this context will be processed in accordance with the above-mentioned principles and also exclusively in order to make a decision regarding the establishment of an employment relationship. The legal basis for this is Art. 6 Para. 1 (b), Art. 88 (GDPR) in conjunction with Sect. 26 Para. 1 BDSG.
We will treat your data as confidential and comply with the principle of using data for a specific purpose. In addition to this, technical and organizational measures are in place to protect all personal data that is gathered and processed within the scope of a job application procedure against unauthorized access.
Your data may be transmitted to external service providers – e.g. IT service providers; companies that destroy or archive data; or printing service providers – who assist us with data processing within the scope of contract data processing and are subject to strict instructions. In addition to this, any transmission of data to public institutions and authorities that are entitled to obtain information will only take place within the scope of our legal obligation to provide information or if a court ruling obliges us to provide information. Your data will not be transmitted to any other third parties.
No data processing takes place outside of the EU or the EEA. We will not sell or otherwise market your personal data to third parties.
Your data will be erased as soon as storage is no longer required and/or our legitimate interest in storage has lapsed. Insofar as you are not offered a position, then standard procedure is data to be erased at the latest six months after the application process has ended. This applies correspondingly to other job application processes insofar as you have provided your consent to your application being considered for other vacancies. Erasure of your data will, furthermore, be carried out without delay after you withdraw consent, insofar as no application process is still ongoing. Where we have a legal obligation to store data for a specific period, the relevant data will be archived until this period expires.
Data subjects have the right to receive information from the data controller regarding personal data that concerns them as well as to rectification of incorrect data or erasure insofar as one of the provisions listed in Art. 17 GDPR applies; for example, if the data is no longer required for the stated purpose. In addition to this, data subjects have the right to restriction of processing if one of the provisions listed in Art. 18 GDPR applies and, in cases subject to Art. 20 GDPR, the right to data portability. All data subjects also have the right to lodge a complaint with a supervisory authority if they believe that processing of their personal data infringes data protection regulations. The right to complain can be exercised in particular with a supervisory authority in the member state in which the data subject is resident or located in where the alleged infringement took place.
